Schleich Text Message Terms of Service
The Schleich text messaging service (the "Service") is operated by Schleich USA Inc. (“Schleich”, “we”, or “us”). By “opting in” or using the Service, you accept these Terms of Service (“Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
Definitions
- “Text Message Service” is defined as any arrangement where Schleich sends (or indicates that it may send, or receives a request that it send) one or more SMS/text messages to you as a consumer.
- “Opting in” or “Opt in” is defined as consumer’s request, enrollment, acknowledgment, and consent to receive one or more text messages from Schleich.
Service Provided
Message content and frequency may vary. SMS/text messages may include service-related messages including updates, alerts, and information (e.g., order updates, account alerts, etc.) or promotional messages such as promotions, back-in-stock notifications, new product alerts, and other marketing offers.
Schleich does not charge for participation in the Service, but there may be charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opting In to Service
By consenting to the Service, you authorize Schleich to use an autodialer or nonautodialer technology to send you recurring SMS/text messages through your wireless provider to the mobile number you provide. When you opt-in to the Service, Schleich will send you at SMS/text message to verify your phone number and confirm your signup.
You understand that you do not have to sign up or opt-in to the Service in order to make any purchases, and your consent is not a condition of any purchase with Schleich. Your participation in this Service is completely voluntary and can be withdrawn at any time by replying STOP to a message or using the unsubscribe link provided in a text message. Message frequency varies and you may opt-out from receiving the Services at any time.
Upon your request to sign-up for the Service, you will receive two (2) text messages as part of the process confirming your desire to opt-into the Program (first an opt-in request message, and once you have replied “Yes” you will receive a sign-up confirmation message).
By opting-in to the Service, you confirm that you are providing a valid phone number and that you are the subscriber to the provided phone number or that you are the customary user of that phone number on a family and/or business plan. You acknowledge that you are authorized to opt-in using that phone number. If you get a new mobile number, you will need to sign up for the program with your new number.
Opting Out of Service
You may opt-out of the Service at any time by texting STOP to [insert your sending number] or by following the instructions to unsubscribe via the link provided in the text message. Your opt-out request may a one-time opt-out confirmation text message. No further messages will be sent to your mobile device. After this, you will no longer receive messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again. If you have subscribed to other Schleich mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
We may change any telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
To the extent permitted by applicable law, you agree that Schleich is not liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. The wireless carriers supported by the Service are not liable for delayed or undelivered messages.
Intended User
This Service is available to adults residing in Canada only. The Service is not intended for children under 13, and Schleich does not knowingly collect information from children under the age of 13.
Children aged 13 or older should not submit any Personal Information without the permission of their parents or guardians. By using the Service, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ permission to use the service.
Governing Law, Jurisdiction, and Venue
You agree that the U.S. Federal Arbitration Act, applicable federal law, and the laws of the state of North Carolina, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Schleich.
If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. If for any reason a claim proceeds in court rather than in arbitration, the case will be heard exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you hereby consent to the exclusive personal jurisdiction and venue of these courts for the resolution of any such disputes. You also hereby agree that any such disputes will be resolved only on an individual basis, not on a collective basis.
For Quebec consumers: These Conditions of Use and any dispute of any sort that might arise between you and Schleich shall be governed by the laws of the Province of Quebec, without reference to its conflict of laws provisions, and the laws of Canada applicable therein, and any disputes in which it is necessary to proceed in court rather than in arbitration will be submitted to the courts of competent jurisdiction of the District of Montreal (Quebec).
